2. Services Provided

We provide food delivery and catering services (the "Services") as described on our website. We reserve the right to modify menu offerings, delivery zones or pricing at any time.

3. Account Registration and Eligibility

a) Eligibility: You must be at least 18 years old and legally capable of entering into binding contracts to create an account or make purchases on our platform. b) Account Information: When you register, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. c) Use of Account: You agree not to share your login details, impersonate another user, or create multiple accounts for fraudulent purposes. d) Updates: Please ensure your profile information (contact, address, payment details) remains up-to-date to enable smooth delivery and service. e) Responsibility: Smokey Jollof is not liable for any loss or damage arising from your failure to protect your account information.

4. Ordering & Payment

a) Orders must be submitted via the website or authorised channels. b) Payment must be completed before dispatch unless otherwise agreed. c) All prices are in Nigerian Naira (₦) and the pricing shown includes food, but may exclude delivery fees, and taxes. d) We accept the payment methods listed; you must ensure your payment method is valid and has sufficient funds.

5. Delivery & Acceptance

a) We'll deliver to the address you provide; please ensure access is clear and accurate. If you live in an estate where access is required for our delivery to enter, please provide access code before delivery gets to the location where the access code will be required. If a phone call to the estate gate is required, please be available to make the phone call when alerted by our delivery team. b) Delivery times are estimated; we cannot guarantee exact arrival times due to external factors. c) Upon delivery you are responsible for checking the order. Complaints must be made within 2 hours of the item delivery.

6. Cancellations & Refunds

a) Cancellation of orders is only allowed if you contact us prior to food preparation/dispatch. b) Catering cancellations or major changes may incur charges if close to event time. c) Refunds where approved will be processed to your original payment method; timing depends on financial institution.

7. Allergies & Dietary Restrictions

We make reasonable efforts to address dietary needs but cannot guarantee a completely allergen-free environment. You assume full responsibility for any adverse reaction.

8. Termination and Account Suspension

a) By You: You may close your account at any time by contacting our support team. Pending orders must be completed or cancelled according to our cancellation policy. b) By Us: Smokey Jollof reserves the right to suspend or terminate your account, restrict access to our website, or cancel any orders if: • We suspect fraudulent, abusive, or illegal activity; • You violate these Terms or applicable laws; • You engage in conduct harmful to other customers, staff, or the company's reputation. c) Consequences: Upon suspension or termination, your right to use our services will immediately cease. Outstanding balances remain payable, and we may refuse future access at our discretion. d) Retention: We may retain certain information for legitimate business or legal reasons after account closure, as described in our Privacy Policy.

9. Intellectual Property

All content on the website including text, graphics, logos, images, is owned by or licensed to us. You may not reproduce or use them without authorisation.

10. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential losses from use of our Services. Our liability in respect of any claim is limited to the amount you paid for the order in question.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes will be subject to the exclusive jurisdiction of the courts in Lagos, Nigeria.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on the website and your continued use constitutes acceptance.
